1. About Us
Paybeez is a digital service operated by BILLWING ESOLUTIONS (OPC) PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having CIN U62013DL2024OPC436610 and its registered office at House no. 1262, Block L, Mangolpuri, North West Delhi, Delhi 110083, India.
Paybeez enables Users to top up their wallet and use it to recharge prepaid mobile connections, pay postpaid bills, DTH, electricity, broadband and other utility services through licensed upstream aggregators. Paybeez is not a bank, NBFC or payment system operator and does not hold customer funds beyond the wallet balance held in trust with our regulated payment partners.
2. Eligibility
- You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
- You must be a resident of India and have a valid Indian mobile number.
- The information you provide during registration (name, mobile, email, KYC documents where applicable) must be true, current and complete.
- You may not use the Platform if you are barred from receiving services under any applicable law, including OFAC, UN or RBI sanctions lists.
3. Account, Security and KYC
- A Paybeez account is created using OTP verification of your mobile number. You are solely responsible for safeguarding your OTPs, PIN/password and access tokens.
- For wallet usage above thresholds prescribed by the Reserve Bank of India (RBI), we may require minimum KYC or full KYC. We may suspend features until verification is complete.
- You must immediately notify us at support@paybeez.in of any unauthorised use of your account. We are not liable for losses arising from your failure to safeguard your credentials.
4. Paybeez Wallet — Closed-Loop Top-Up (Important)
The Paybeez Wallet is NOT a bank account, NOT a Prepaid Payment Instrument (PPI) issued by a bank, and NOT real money. It is a closed-loop, single-purpose top-up balance — think of it as service points — usable only to purchase recharge and bill-payment services listed on the Platform.
By adding money to your Paybeez Wallet, you specifically acknowledge and agree that:
- Non-refundable to source. Once a top-up is successfully credited to your Wallet, the amount cannot be transferred back to your bank account, UPI, debit card, credit card, or any other instrument, and is not exchangeable for cash.
- Non-transferable. Wallet balance cannot be transferred, gifted, sold, assigned or otherwise moved to any other Paybeez user, person, account or wallet.
- Single-purpose use only. The balance can be used solely to pay for recharges, bill payments and similar services made available on Paybeez. It cannot be withdrawn, encashed, used for peer-to-peer payments, used to pay merchants outside Paybeez, or used as a remittance instrument.
- No interest. No interest, return, dividend, reward or yield of any kind is payable on the Wallet balance.
- Not a deposit. The Wallet balance is not a deposit, is not insured by DICGC or any other deposit insurance scheme, and does not represent a claim on any bank.
- Top-up failures only. If your bank is debited but the Wallet is not credited, that specific failed top-up is auto-reversed to source per RBI TAT — see the Refund Policy. This is the only path by which money flows back to your bank.
- Failed-recharge refunds stay in the Wallet. If a recharge fails after a successful Wallet debit, the amount is credited back to the same Wallet — not to your bank.
- Convenience fees, GST and statutory charges (if any) are disclosed before you confirm a transaction.
- We may decline, hold or reverse any Wallet transaction we reasonably suspect of being fraudulent, abusive, in violation of law, or initiated in error.
- Top-ups are processed through licensed Payment Aggregators / Payment Gateways. By adding money you also accept the terms of the relevant gateway.
Reverse-to-bank only on account closure. The only exception to the above is at the time of permanent account closure: any residual Wallet balance, after deduction of legitimate dues and after KYC verification of the source bank account, may be returned to a verified bank account at the Company’s discretion within 7–10 working days. This is a closure-only courtesy refund and not a withdrawal facility.
5. Recharges and Bill Payments
- When you submit a recharge or bill payment request, you authorise us to debit the corresponding amount from your wallet and forward the request to the operator/biller via our upstream aggregator.
- Recharges are typically delivered within seconds, but timing depends on the operator. A request marked SUCCESS by the operator is considered fulfilled.
- If the operator returns FAILURE, the debited amount is automatically refunded back to your wallet. Refer to the Refund Policy for details.
- You are responsible for ensuring that the mobile number, account number, circle, operator and amount entered are correct. Once a request is submitted to the operator, it cannot be cancelled by us.
6. Acceptable Use
You agree not to:
- Use the Platform for any unlawful, fraudulent, money-laundering or terror-financing activity.
- Attempt to access another User’s account, scrape, reverse-engineer or interfere with the Platform.
- Use bots, scripts or automated tools to place transactions or to bypass rate limits.
- Resell, sublicense or commercialise the Platform without our prior written consent.
Violation may result in suspension or permanent termination of your account, forfeiture of disputed wallet balance subject to law, and reporting to law-enforcement authorities.
7. Intellectual Property
All content on the Platform — including the “Paybeez” brand, logos, UI, code, copy and graphics — is owned by or licensed to the Company and protected under Indian and international IP laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to use the Platform for personal, lawful use only.
8. Third-Party Services
The Platform integrates services from third parties such as payment aggregators, recharge aggregators and operators. We are not responsible for outages, errors or losses caused by third-party systems beyond the wallet refund mechanism described above.
9. Disclaimer of Warranties
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, accuracy and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, the Company’s aggregate liability arising out of or relating to your use of the Platform shall not exceed the lesser of (a) the convenience fees actually paid by you to the Company in the twelve (12) months preceding the claim, or (b) ₹5,000. We shall not be liable for indirect, incidental, special, consequential or punitive damages.
11. Indemnity
You agree to indemnify and hold harmless the Company, its directors, employees and partners from any claim, demand, loss or expense (including legal fees) arising out of (i) your breach of these Terms, (ii) your violation of any law, or (iii) your infringement of any third-party right.
12. Suspension and Termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or if required by a regulator, court or law-enforcement authority. You may close your account at any time by writing to support@paybeez.in; closure is subject to settlement of any pending obligations.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute shall first be attempted to be resolved through good-faith negotiation. Failing that, it shall be referred to a sole arbitrator appointed by the Company under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be New Delhi, India and proceedings shall be conducted in English. Subject to arbitration, the courts at New Delhi shall have exclusive jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. The updated version takes effect when posted on the Platform with a revised “Effective date”. Your continued use of the Platform after the change constitutes acceptance.
